JUDGMENT OF THE EMPLOYMENT TRIBUNAL 30 The judgment of the Employment Tribunal is that the claim is dismissed.
REASONS 35 1. The claimant presented a claim of unfair dismissal on the 2 December 2024. The claim was resisted and a final hearing was fixed. Unfortunately, due to technical difficulties the hearing on the original hearing date fixed 24th of February had to be adjourned and the hearing continued to dates in March and May. 2. The respondents accept that the claimant was dismissed. There is an issue 5 as to the reason for dismissal. The claimant challenges the fairness of dismissal under Section 98(4) of the Employment Rights Act 1996 (the “ERA”). The dismissal is said to be unfair as a result of the procedure adopted by the respondents and delay. It is also said that dismissal was too harsh a penalty. 10
