EMPLOYMENT TRIBUNALS (SCOTLAND) Case No: 8001815/2025 Held in Aberdeen via Cloud Video Platform (CVP) on 27 May 2026 Employment Judge R King Mr E Osman Claimant Represented by: Mr R Clarke - Solicitor Langstane Housing Association Limited Respondent Represented by: Mr E Stafford - Solicitor
JUDGMENT OF THE EMPLOYMENT TRIBUNAL The Judgment of the Tribunal is that: 1. the claimant has a disability within the meaning of section 6(1) of the Equality Act 2010; and 2. the claimant made a protected disclosure in terms of section 43A of the Employment Rights Act 1996, in his e-mail to Helen Gauld dated 19 March 2025.
REASONS
1. This preliminary hearing was fixed to determine two disputed issues; firstly, whether the claimant has a disability in terms of section 6(1) of the Equality Act 2010 and secondly whether, in an email he sent to Helen Gauld, the respondent’s chief executive, on 19 March 2025, he made a qualifying disclosure in terms of section 43A of the Employment Rights Act 1996.
2. At the outset, Mr Clarke explained that the material time in relation to the claimant’s asserted disability was between 21 May 2025 and 2 December 2025, which was the period between his having raised a grievance and his dismissal by the respondent.
